To be named a habitual offender in New Hampshire, the Director of Motor Vehicles agrees that your driving behavior shows disrespect for the law and a violation to safety. You will be required to attend a hearing and an examination of your driving record will decide if your license should be revoked for one to four years. There are procedures to avoid these hearings or the possibility of being declared a Habitual Offender that we are successful at, such as having prior convictions vacated.
If declared a habitual offender you should seek a good lawyer and should you be stopped driving after having been declared a habitual offender you will be looking at jail time of a minimum of one year up to a possible five years. New Hampshire takes this very seriously.
To get your New Hampshire driver's license back, habitual offenders must meet all requirements of the court including 1 to 4 years of suspension, improvement training, and other training courses.
There are Point Reduction Programs
If you have accumulated points on your license there are improvement training programs that can reduce 3 points off your record. If you can just reduce the number of points on your license you could limit your chance of suspension. In New Hampshire, you are eligible for a three-point reduction one time in every three year period.
To take advantage of the three-point reduction program you must attend an approved Improvement Program through the NH DMV. It can improve your road safety, and also, the New Hampshire DMV will take three points off your license.
Reinstatement of a Suspended License
If you have fulfilled all the appropriate requirements of your suspension you can then apply for reinstatement of your driver's license. You will need to bring your reinstatement fee and proof of insurance, usually an SR-22 Form.
